Promulgated: SEP ., 7 2012 X---------------------------------------------------------------------------------------------------X RESOLUTION On July 25, 2012, petitioner filed a "Motion to Withdraw (The Petition for Review Dated 15 July 2011)," stating that it is currently discussing with the Bureau of Internal Revenue a possible amicable settlement of the dispute in this particular case. On July 31, 2012, the Court issued a Resolution ordering respondent to comment on the "Motion to Withdraw (The Petition for Review Dated 15 July 2011)." However, on August 15, 2012, the Records Division issued a Records Verification stating that respondent failed to file her comment.

RESOLUTION CTA Case No. 8316 During the hearing held on August 23, 2012, the Court granted petitioner ten (10) days or until September 2, 2012 within which to file the appropriate pleading with regards to the withdrawal of the Petition for Review. On September 6, 2012, petitioner filed its "Manifestation with Motion to Submit for Resolution (The Motion to Withdraw Petition Dated 20 July 2012)." In view of the foregoing, the "Motion to Withdraw (The Petition for Review Dated 15 July 2011)" shall be resolved. There being no objections from respondent, the Court sees no reason not to grant the "Motion to Withdraw (The Petition for Review Dated 15 July 2011)," as this will allow the parties to amicably settle the current dispute. WHEREFORE, petitioner's "Motion to Withdraw (The Petition for Review Dated 15 July 2011)" is hereby GRANTED . The Petition for Review is hereby deemed WITHDRAWN.
