SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW OF ATTY. WILMA DONNA C. ANQUILO-GARCIA
For your information and guidance, quoted hereunder is the Resolution dated 28 February 2018 of the Special Third Division in Administrative Case No. 8698, entitled "Manuel B. Bernaldez v. Atty. Wilma Donna C. Anquilo-Garcia," to wit:
The Court NOTES complainant's Comment dated August 9, 2017 on respondent's motion for reconsideration of the Resolution dated August 31, 2016 which revoked her notarial commission; disqualified her from reappointment as notary public for a period of one (1) year; and suspended her from the practice of law for a period of six (6) months.
Acting on respondent's motion for reconsideration of the Resolution dated August 31, 2016, the Court resolves to DENY the motion with FINALITY , as no substantial matters were raised to warrant its reconsideration.
Considering the Report and Recommendation dated October 24, 2017 of the Office of the Bar Confidant (OBC) submitting that respondent has fully served the six month suspension from the practice of law from March 24, 2017 to September 24, 2017, the Court, upon the recommendation of the OBC, resolves to LIFT the order of suspension from the practice of law imposed on Atty. Wilma Donna C. Anquilo-Garcia and ALLOW her to RESUME her practice of law and REINSTATE to her position as Prosecutor I upon order of the Department of Justice.
However, the order of her disqualification from performing her notarial act shall remain effective until March 24, 2018. Upon the lapse of the period and full service of the said disqualification, respondent is required to file a sworn statement with motion to lift order of disqualification with certifications from the Department of Justice, Regional Prosecution Office, Tacloban City and Executive Judge of the courts where she appeared as prosecutor and IBP Catarman Chapter, affirming that she has not been commissioned as notary public from March 24, 2017 to March 24, 2018.
The said report and recommendation of the OBC is NOTED .
No further pleadings, motions, letters or other communications shall be entertained in this case.
