ADMINISTRATIVE CIRCULAR NO. 66-2005 APPROPRIATING THE ADDITIONAL AMOUNT OF THIRTY MILLION PESOS FROM THE TWENTY PERCENT (20%) ALLOTMENT FOR EQUIPMENT AND FACILITIES OF THE JUDICIARY DEVELOPMENT FUND FOR THE CONSTRUCTION OF THE COURT OF APPEALS BUILDING IN CEBU CITY

WHEREAS, pursuant to Republic Act No. 8246, six new Divisions of the Court of Appeals, the Eighteenth to the Twenty-Third, were established, with the first three stationed in Cebu City and the other three, in Cagayan de Oro City;

WHEREAS, on 15 October 2004, the Cebu City station for the Eighteenth, Ninetheenth, and Twentieth Divisions was formally inaugurated; while the Cagayan de Oro station for the Twenty-First, Twenty-Second, and Twenty-Third Divisions was inaugurated on 7 December 2004;

WHEREAS, the two stations are housed in privately-owned buildings rented by the Court of Appeals;

WHEREAS, as sites for the permanent buildings for these stations, the Provincial Government of Cebu donated the usufruct of a lot with an area of 2,011 square meters located near the Cebu Provincial Capitol Building and the Government of the City of Cagayan donated a lot with an area of 2,189 square meters located near the Cathedral in Cagayan de Oro City;

WHEREAS, on 22 October 2005 the Province of Cebu passed a resolution donating the property earlier subject of the donation of usufruct to the Supreme Court for the same purpose and authorizing Governor Gwendolyn F. Garcia to sign the deed of donation; the deed of donation was finally the Supreme Court of the Philippines, represented by the Chief Justice, on 22 October 2005, on which ocassion the cornerstone of the building was laid; this deed of donation of the lot itself removes all obstacles to the start of the construction of the Court of Appeals Building in Cebu City;

WHEREAS, in Administrative Circular No. 2004 the Chief Justice alloted P40 Million would not be enough for the construction thereof;

NOW, THEREFORE, pursuant to and by virtue of his authority under Presidential Decree No. 1949, establishing the JDF, the Chief Justice hereby appropriates the additional sum of P30 Million from the twenty percent (20%) allocation for equipment and facilities of the JDF, for the construction of the Court of Appeals Building in Cebu City.

The Committee on Halls of Justice, the Bids and Awards Committee on Halls ot Justice the Bid and Award Committee for Construction, the Prequalitication Evaluation and Awards Committee for Consultancy (as strengthened Administrative Circular No. 11-2004), and the Fiscal Management and Budget Office, in coordination with the Presiding Justice of tbe Court of Appeals, shall implement this Administrative Circular.

This Administrative Circular shall take effect upon its ratification by the Court en banc.
