SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW OF ATTY. MARCELINO CABUCANA, JR.

For your information and guidance, quoted hereunder is the Resolution dated 10 October 2016 of the Second Division in Administrative Case No. 10185, entitled "Licerio Dizon v. Atty. Marcelino Cabucana, Jr.," to wit:

Acting on the respondent's motion to lift order of suspension, with attached documents, dated 8 August 2016, in compliance with the Resolutions dated 12 March 2014 and 2 September 2015 and considering that respondent has submitted a sworn statement that he has served the three (3)- month suspension from the practice of law from 29 April 2014 to 29 July 2014 and certifications from the Executive Judge of RTC, Brs. 21, 35 and 36, Santiago City, Isabela and IBP Isabela Chapter affirming that respondent has desisted from the practice of law from 29 April 2014 to 29 July 2014 and that he has not perform any Notarial act from 29 April 2014 to 29 July 2016, the Court resolves to LIFT the order of suspension from the practice of law imposed upon respondent Atty. Mercelino Cabucana, Jr. for three (3) months and disqualification from performing notarial act for two (2) years, and to ALLOW him to resume his practice of law.

The Court NOTES the Report and Recommendation dated 31 August 2016 of the Office of the Bar Confidant.
