Reynold Tabbu and respondent's counsel Atty. Wilmer Dekit appeared. Atty. Reynold Tabbu manifested that petitioner witness Urbano L. Velasco is not available today. Respondent's counsel moved to dismiss this case on the ground that petitioner was given several opportunity to present his case and the resetting during the hearing held on June 4, 2013 was for the last time with the condition that should petitioner again not appear, he would be deemed to have waived the right to present evidence. In view of the foregoing and finding merit, the motion to dismiss this case is hereby GRANTED. This case is hereby DISMISSED. SO ORDERED.
