[ OCA CIRCULAR NO. 84-2012, September 10, 2012 ]
TO : ALL JUDGES AND CLERKS OF COURT OF THE FIRST AND SECOND LEVEL COURTS
SUBJECT : REQUEST OF THE BUREAU OF IMMIGRATION TO (A) FURNISH THE BUREAU OF IMMIGRATION DEPORTATION TASK FORCE (BIDTF) WITH COPIES OF ALL NOTICES, ORDERS AND OTHER PROCESSES IN CASES INVOLVING FOREIGN NATIONALS WHO ARE DETAINED AT THE BUREAU OF IMMIGRATION DETENTION CENTER; AND (B) EXPEDITE THE RESOLUTION OF CASES INVOLVING FOREIGN NATIONALS
In his July 24, 2012 letter, Commissioner Ricardo A. David, Jr. of the Bureau of Immigration states that The Bureau of Immigration Deportation Task Force (BIDTF) is in the process of monitoring the progress of cases filed against foreign nationals who are currently detained at the Bureau of Immigration Detention Center, Camp Bagong Diwa, Bicutan, Taguig City.
According to Commissioner David, it has been observed that several notices, orders and other processes issued by the different trial courts in cases involving accused foreign detainees and addressed to the warden of the Bureau of Immigration Detention Center were not complied with because of late receipt or miscommunication. This has contributed to the delay in the trial proceedings of the cases.
To address the aforementioned concerns, the Bureau of Immigration requests that (a) the BIDFT be furnished with copies of all notices, orders and other processes in cases involving foreign nationals who are detained at the Bureau of Immigration Detention Center; and (b) the cases involving foreign nationals be resolved expeditiously.
Accordingly, you are hereby DIRECTED to:
1. FURNISH the BIDTF, Bureau of Immigration, Magallanes Drive, Intramuros, 1002 Manila with copies of all notices, orders and other processes in cases involving foreign nationals who are detained at the Bureau of Immigration Detention Center; and
2. EXPEDITE the resolution of cases involving foreign nationals.
