TO: ALL JUDGES AND CLERKS OF COURT OF THE REGIONAL TRIAL COURTS, METROPOLITAN TRIAL COURTS, MUNICIPAL TRIAL COURTS IN CITIES, MUNICIPAL TRIAL COURTS AND MUNICIPAL CIRCUIT TRIAL COURTS
SUBJECT: FINES IMPOSED BY THE COURT FOR VIOLATION OF MUNICIPAL ORDINANCES
Section 93 of the Judiciary Act of 1948 provides among others :
"xxx all monies paid in the nature of fines and costs by persons convicted for violations of municipal or city ordinances shall accrue exclusively to the city, municipality or municipal district in meeting its obligations as defined under section 74 and 75 of this act."
Thus, the Second Division of this Court in its resolution dated 14 January 2002 in Administrative Matter No. 01-10-262-MTC Re: Letter Dated 25 September 2000 of Anita D. Macawile, Clerk of Court, MTC, Babatngon, Leyte resolved to:
" xxx (1) CONSIDER the fines paid for violations of local ordinances to have accrued exclusively to the local government; xxx."
In the said resolution Clerk of Court Macawile was authorized to withdraw the amount paid as fine and remit the same to the municipal government of Babatngon, Leyte.
In view of the forgoing, all Clerks of Court are hereby directed to remit to the local government unit, the fines paid for violations of local ordinances.
