Layug-Delfin appeared for the respondents. However, petitioner's counsel , Atty. Manuel R. Castro, who was notified, failed to appear despite notice. The Court NOTED that there was also no submission of the required Secretary Certificate from petitioner's counsel. Due to the absence of Atty. Castro, who was notified , Solicitor Layug-Delfin moved for the dismissal of the case. Accordingly, in view of the unjustified absence of petitioner's counsel , pursuant to Sections 4 and 5 of Rule 18 of the Rules of Court, as amended, the Court is constrained to GRANT the motion. Accordingly, this case is DISMISSED.
