Petitioner avers that on February 13, 2025, it filed a Petition for Review dated February 10, 2025 before the Court. The said Petition prays, among others, that judgment be rendered ordering: 1. The reversal and setting aside of the Regional Tria l Court's Decision dated June 6, 2024, and Order dated January 7, 2025; 2. The cancellation in full of the Environmental Tax Order of Payment issued against it for taxable year 2023; and

Respondents to refund the amount of Php3,324,825.00 to petitioner; or in the alternative, refund the amount of Php2,967,300.00 in excess of the Environmental Tax assessed based on outdated Environmenta l Compliance Certificates. Petitioner now seeks to withdraw the present Petition for Review, stating that, after a thorough review and reassessment of the circumstances, it has decided to focus its efforts and limited resources on pursuing its appeals "to dispute the assessment of Environmental Tax for the years 2017, 2019 and 2020, which are pending before the Court of Tax Appeals En Bane or the Supreme Court in Division." Hence, petitioner filed the instant Motion in accordance with Section 3, Rule 1 of the Revised Rules of the Court of Tax and Section 3 , Rule 50 of the 1997 Rules of Civil Procedure, as amended. In their Comments/ Opposition to the Motion to Withdraw Petition for Review (Filed on Febrnary 10, 2025), filed on September 24 , 2025, and r eceived by the Court on September 30, 2025, respondents interpose no objection to the withdrawal of the Petition for Review. Finding m erit in the Motion to Withdraw Petition for Review , and there being no objection from respondents , the Court resolves to GRANT the same. WHEREFORE, the Petition for Review dated February 10, 2025, is hereby deemed WITHDRAWN. Accordingly, the present case is DECLARED CLOSED and TERMINATED. SO ORDERED. ~~ LANEE S.
