SUBJECT : SUSPENSION FROM THE PRACTICE OF LAW FOR ONE (1) YEAR OF ATTY. MARIANO R. PEFIANCO

For your information and guidance, quoted hereunder is the dispositive portion of the Resolution of the Third Division dated 1 August 2012, in Administrative Case No. 6116, entitled "Engr. Gilbert Tumbokon v. Atty. Mariano R. Pefianco," to wit:

WHEREFORE, respondent ATTY. MARIANO R. PEFIANCO is found GUILTY of violation of the Lawyer's Oath, Rule 1.01, Canon 1 of the Code of Professional Responsibility and Rule 9.02, Canon 9 of the same Code and SUSPENDED from the active practice of law for ONE (1) YEAR effective upon notice hereof.

In a Resolution dated 14 November 2012, the Court further DENIED with FINALITY the respondent's motion for reconsideration, as 'no substantial matters were raised to warrant its consideration. Respondent received on 3 January 2013 the Resolution of the Court dated 14 November 2012 which denied his motion for reconsideration.
