CREATING AND ESTABLISHING THE SPECIAL DEVELOPMENT FUND
TECHNICAL WORKING GROUP (SDF-TWG) AND SPECIAL DEVELOPMENT FUND - PROJECT MANAGEMENT OFFICE (SDF-PMO) UNDER THE OFFICE OF THE CHIEF MINISTER, AND DEFINING THEIR
SCOPES OF AUTHORITY
WHEREAS, pursuant to Section 2, Article XIV of Republic Act No. 11054 or the Bangsamoro Organic Law (BOL), the National Government shall provide a Special Development Fund to the Bangsamoro Government for the rebuilding, rehabilitation, and development of its conflict-affected communities. The amount equivalent to Fifty Billion Pesos (PhP 50,000,000,000.00), at Five Billion Pesos (PhP 5,000,000,000.00) per year, for a period of 10 years from the ratification of the BOL shall be allocated for this purpose;
WHEREAS, under Section 6, Article XIII of the BOL, the utilization of SDF shall be in accordance with the Bangsamoro Development Plan (BDP) to be adopted by the Bangsamoro Government;
WHEREAS, the BDP 2020-2022 was adopted and approved by the Bangsamoro Economic and Development Council and Bangsamoro Transition Authority (BTA) Parliament on June 5, 2020 and July 3, 2020, respectively;
allocation for the Bangsamoro Government. The same has been reflected under the special provisions of the General Appropriations Act of the Billion Pesos (PhP 10,000,000,000.00) for FY 2020 and FY 2021 as SDF WHEREAS, the National Government appropriated the sum of Ten
Bangsamoro (GAAB) for FY 2020 and FY 2021, respectively;
WHEREAS, Section 27, Article VI of the BOL requires that no public money, including the block grant and other National Government subsidies and support funds given in lump sum, shall be spent without an appropriations law clearly defining the purpose for which it is intended. The BTA Parliament shall pass an annual appropriation law;
WHEREAS, the BTA Parliament enacted the Bangsamoro Autonomy Act (BAA) No. 22 entitled, "An Act Appropriating the Sum of Ten Billion Pesos (PhP 10,000,000) from the 2020 and 2021 Special Development Fund, and for 0ther Purposes"on October 8,2021;
WHEREAS,Section 8 of BAA No.22 provides for the creation of the SDF TWG which shall be chaired by the Senior Minister, with the Bangsamoro

SECTION 1.Creation of SDF-TWG.There is hereby created a Special

(BWC) Attorney General's Office (BAGO) Chairperson, Bangsamoro Women Commission
Secretariat: BPDA
SECTION 3. Responsibilities. The SDF-TWG shall discharge the following responsibilities in accordance with Section 8 of BAA No.22,viz:
a) Facilitate the preparation and consolidation of PPAs to be funded
under the 2020 and 2021 Special Development Fund;
b) Review and evaluate the SDF-PPAs;
c) Ensure that the SDF-PPAs are gender responsive;and
d) Perform such other functions as may be assigned by the Chief
Minister.
SECTION 4. Finalization and approval of SDF-PPAs. The SDF-TWG shall submit to the BPDA the consolidated SDF-PPAs for review and evaluation to ensure that it is consistent with the BDP.
The BPDA Director General shall submit the SDF-PPAs for approval of the Chief Minister.
SECTION 5.Establishment of SDF-PMO.A Special Development Fund - Project Management Office (SDF-PMO) is hereby organized and established to ensure that the SDF-supported PPAs as well as their project implementation are consistent with the identified development priorities, plans and specifications in the BDP 2020-2022.
SECTION 6. Mandate. The SDF-PMO shall ensure the accountability of public officials in the implementation of projects and programs of the Bangsamoro Government which will be funded through the herein SDF, as

b. Provide advisory or technical support to all concerned implementing
ministries, agencies and offices in the implementation of SDF-PPAs.
c.Prepare and submit the consolidated Annual Work Plans (AWP) of
implementing ministries, agencies and offices to the Office of the Chief Minister.
d. Manage, certify, and report financial disbursements of implemented
projects based on the approved AWP and Schedule of Payment.
e. Ensure documentation, evaluation and periodical reporting on the
physical progress of SDF-PPAs' implementation, and submit the same to the MFBM,DBM or the Office of the Chief Minsiter as the case may be.
f. Ensure effective, efficient, timely, and accountable implementation
of SDF-supported PPAs.
g. Maintain meaningful coordination and cooperation with relevant stakeholders to determine the impact and outcome of the SDF-PPAs.
SECTION 9. Implementation Arrangement. The SDF-PMO shall work
any ministry, bureau, office, agency or instrumentality of the Bangsamoro closely with the SDF-TWG and the Office of the Chief Minister. It may call upon Government for such assistance as it may need in the performance of its functions.

SECTION 13.Separability Clause. Should any provision of this Order be declared invalid or unconstitutional, the other provisions unaffected thereby shall remain valid and subsisting.
SECTION 14.Repealing Clause.This Order repeals BARMM Special Order No.004,s.2020 and E0 No.003,s.2021.
All other regional orders, proclamations, rules and regulations, or parts thereof, which are inconsistent with any of the provisions of this Order are hereby repealed or modified accordingly.
SECTION 15.Effectivity. This Order shall take effect fifteen (15) days following the completion of its publication in the Bangsamoro Gazette or in a newspaper of regional circulation.
