ASUMPtION OF POWERS AND FUNCtIONS OF POEA ADMINISTRATOR
Whereas, R.A. No. 11641, known as the "Department of Migrant Workers Act", took effect on February 03, 2022, fifteen (15) days after its complete publication in the Official Gazette and in two (2) newspapers of general circufation;
Whereas, Section 19 of said Act mandates that:
Department, and their powers and functions subsumed to the Department which agencies are hereby consolidated and merged into and constituted as the "Sestion 19. Consolidation and Merger of Agencies and Functions. -- The following
shall assume and perform all their powers and functions: (a) The POEA, as created under Executive Order No. 247 and Republic Act No. 8042,
(b) The Office of the Undersecretary for Migrant Workers' Affairs (OUMWA) of the DFA as amended;
as provided under Republic Act No. 8042, as amended; (c) AIl Philippine Overseas Labor Offices (POLO) under the DOLE; (d) The International Labor Affairs Bureau (ILAB) under the DOLE; (e) The National Reintegration Center for OFWs (NRCO) under the OWWA; (f) The National Maritime Polytechnic (NMP) under the DOLE; and (g) 'The Office of the Social Welfare Attache (OSWA) under the DSWD;
Whereas, Section 8 of the Act vests in the Secretary "the authority and responsibility for the exercise of the mandate, powers, and functions of the Department" and gives him the responsibility to "exercise supervision and control over the Department"; moreover, in its subsection (m), the same Section 8 empowers him to "Perform such other tasks as provided under existing laws, including the functions of the POEA Administrator under Executive Order No. 247, Republic Act No. 8042, as amended and other laws";
Whereas, having been duly appointed and sworn to my Oath of Office by the President of the Republic as the Secretary of the Department of Migrant Workers and having thus accepted my role as his Alter Ego for the implementation of R.A. No. 11641, the undersigned. in the exercise and by virtue of the plenary and self-executory powers vested in him by both Sections 6 and 8 and other pertinent provisions of the Act, does hereby serve notice of full assumption of the functions of the POEA Administrator:
NOW, THEREFORE, I, ABDULLAH D. MAMA-O, Secretary of the Department of Migrant Workers, do hereby order: CONTROLLED AND DISSEMINAS THE22 By DMW Central Records Division on 1
ADMINISTRATOR AND IMMEDIATE TURN-OVER OF ALL THE DOCUMENTS RECORDS, COMMUNICATIONS, APPLICAtIONS FOR LICENSES, CASE FOLDERS AND RELATED DOCUMENTS. That Atty Bernard P. Olalia shall, upon receipt of this Order, forthwith cease and desist from exercising any and all powers and functions as Administrator of the POEA, and, not later than 24 hours of receipt by his Office of this Order, cause the prompt delivery or turnover to the Secretary of the Department of Migrant Workers of all the documents, records, communications, pending cases, applications for licenses, and such SECTION 1. other related documents in the Administrator's current possession and control. Under the same 24-hour period, the POEA Administrator is likewise ordered to submit to the Secretary of the Department of Migrant Workers the status and inventory reports of all the documents on expenditures, pending cases, applications for licenses, and all other related matters.
SECTION 2. ROLE OF THE ADMINISTRATOR. The POEA Administrator, as Member of the Transition Committee, may continue to assist the Secretary and the other members in the formulation of the Department's structure and staffing pattern and in the preparation of the department's 2023 budget, He might also wish to provide the Secretary with comprehensive orientation on the roles, functions, and practices of the various POEA Offices and of POEA as a whole.
SECTION 3. REPEAL. All previous issuances, orders, or parts thereof which are inconsistent with the provisions of this Administrative Order are hereby repealed or modified accordingly.
SECTION 4. SEPARABILITY. If any provision of this Administrative Order shall be declared unconstitutional, the remainder not otherwise affected shall remain in force and effect.
SECTION 5. EFFECTIVITY. This Administrative Order shall take effect immediately upon publication in a newspaper of general circulation.
