RESOLUTION OF CASES BY THE HOLD-OVER DEPUTY ADMINISTRATOR FOR LICENSING and

ADJUDICATION

Whereas, R.A. No. 11641, otherwise known as "An Act Creating

the Department of Migrant Workers (DMW)" took effect on February 03

2022 following the completion of its publication in the official gazette and

two (2) newspapers of general circulation;

Whereas, under Section 8 (m) of R.A. No. 11641, one of the

powers of the Secretary of Migrant Workers is to execute and implement

such other tasks as provided under existing laws, including the functions of the POEA Administrator under Executive Order No. 247, Republic Act No. 8042, as amended and other laws;

Whereas, the hold-over POEA Administrator whose functions have been duly transferred and assumed by the Secretary of Migrant Workers

under R.A. No. 11641, has also lost his power and authority to resolve

cases under Section 149, Rule VII of the Sea-based workers and Section

165, Rule V of the Land-based workers both under the 2016 POEA Rules

of Procedure;

Whereas, the hold-over Overseas Employment Adjudicators' (OEA)

findings and recommendations, in the form of a draft, under the aforesaid

2016 POEA Rules and Procedure shall now be submitted for decision or

resolution to the Deputy Administrator for Licensing and Adjudication

whose decision shall be appealable to the Secretary of Migrant Workers;

NOW THEREFORE, I, ABDULLAH D. MAMA-O, Secretary Of the Department of Migrant Workers, by virtue of the powers vested in me by R.A. No. 11641 and other existing laws, do hereby order the following:

SECTION 1. TRANSMITTAL OF DRAFT FINDINGS AND RECOMMENDATIONS BY THE OVERSEAS EMPLOYMENT ADJUDICATORS (OEA) TO THE DEPUTY ADMINISTRATOR FOR LICENSING AND ADJUDICATION. The Secretary of Migrant WorkerS, having assumed the functions and powers of the POEA Administrator as mandated under Section 8 (m) of R.A. No. 11641, in addition to the other powers and functions assigned to him by the DMW Act, hereby directs all the hold-over Overseas Employment Adjudicators (OEA) to submit their findings and recommendations mentioned under Section 149, Rule VII of the Sea-based workers and Section 165, Rule V of the Land-based workers both under the 2016 POEA Rules of Procedure to the hold over Deputy Administrator for Licensing and Adjudication, Officer-in-Charge VIRGILIO L. CARREON, JR. for his decision/resolution, appeals from which shall be submitted to the Secretary of the Department.

SECTION 2. REPEAL.All previous issuances, orders, or parts thereof which are inconsistent with the provisions of this Administrative Order are hereby repealed or modified accordingly.

SECTION 3. SEPARABILITY. If any prOVision of this Administrative Order shall be declared unconstitutional, the remainder not otherwise affected shall remain in full force and effect.

SECTION 4. EFFECTIVITY. This Administrative Order shall take effect immediately upon publication in a newspaper of general circulation.
