SUBJECT : SUSPENSION OF ATTY. JUAN S. SINDINGAN FROM THE PRACTICE OF LAW FOR THREE (3) MONTHS
For your information and guidance, quoted hereunder is the Resolution dated 2 August 2017 of the First Division in Administrative Case No. 11614, entitled "Judge Zosimo V. Escano v. Atty. Juan S. Sindingan" to wit:
The Court resolves to NOTE
(1) the Notice of Resolution No. XXI-2014-718 dated October 10, 2014 of the Integrated Bar of the Philippines' Board of Governors which adopted and approved with modification the Report and Recommendation of the Investigating Commissioner dated October 22, 2013, and suspended respondent Atty. Juan S. Sindingan from the practice of law for three (3) months for violation of Rules 11.04 and 11.05 of Canon 11 of the Code of Professional Responsibility; and
(2) the Notice of Resolution No. XXII-2016-324 dated May 28, 2016 of the Integrated Bar of the Philippines' Board of Governors which resolved to deny the motion for reconsideration and affirm respondent's suspension from the practice of law for a period of three (3) months, there being no new reason and/or new argument adduced to reverse the previous findings and decision of the Board of Governors, transmitted by letter dated February 6, 2017 of Director Ramon S. Esguerra together with the records and the compact disc containing the PDF file of the case.
The Court further resolves to ADOPT and APPROVE the recommendation of the Integrated Bar of the Philippines' Board of Governors in its Notice of Resolution No. XXI-2014-718 dated October 10, 2014 (Annex "A") and Notice of Resolution No. XXII-2016-324 dated May 28, 2016 (Annex "B"). Accordingly, respondent Atty. Juan S. Sindingan is SUSPENDED from the practice of law for three (3) months effective from notice hereof, for violation of Rules 11.04 and 11.05 of Canon 11 of the Code of Professional Responsibility.
In a Resolution dated 14 December 2017, the Court DENIED with FINALITY the respondent's Motion for Reconsideration.
