SUBMISSION OF DATA ON SUMMARY PROCEDURE
A study on the effectiveness of the Rules on Summary Procedure is being conducted through the Lawyer's League for Liberty or "LIBERTAS" funded by the Asia Foundation.
In view thereof, all clerks of courts of first level courts are required to submit to the Program Management Office, Supreme Court data on summary procedure within sixty (60) days from receipt hereof, specifically on:
Data of cases that are decided by first level courts through summary procedure and cases decided that did not go through summary procedure, from January to December, 2004 (separate report for each month);
Classification of cases decided through summary procedure according to the following: i) traffic violations, ii) violations of municipal and city ordinances, iii) violations of rental law, iv) BP22 cases, and v) criminal cases with penalty under six (6) months imprisonment, from January to December, 2004 (separate report for each month);
Number of BP 22 cases pending in the first level courts as of 30 March 2003 and number of BP 22 cases as of 31 December 2004; and
Other relevant data on summary procedure within the last five years.
Individual observations and comments on the application of summary procedure, if any, may also be attached to their reports.
