SUBJECT : SUSPENSION FROM THE PRACTICE OF LAW FOR FIVE (5) YEARS OF ATTY. BENJAMIN F. BATERINA

For your information and guidance, quoted hereunder is the dispositive portion of the Decis-ion of the Court En Banc dated 27 January 2015 in Administrative Case No. 8235 entitled "Joselito F. Tejano vs. Atty. Benjamin F. Baterina," to wit:

WHEREFORE, Atty. Benjamin F. Baterina is found GUILTY of gross negligence. He is SUSPENDED from the practice of law ' for five (5) years. He is also STERNLY WARNED that a repetition of the same or similar offense will be dealt with more severely.

Despite receipt of the said Decision on 18 February 2015, the respondent did not file a motion for reconsideration.
