SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW OF ATTY. REX J.M.A. FERNANDEZ

For your information and guidance, quoted hereunder is the Resolution dated 14 March 2018 of the Third Division in Administrative Case No. 10313, entitled "Meriam G. Balagtas v. Atty. Rex J.M.A. Fernandez," to wit:

Acting on the Report and Recommendation dated October 19, 2017 of the Office of the Bar Confidant (OBC) on the Ex-Parte Manifestation of September 5, 2017 and Compliance dated May 25, 2017, filed by respondent, requesting for the lifting of his order of suspension from the practice of law as he has fully served the nine-month suspension from June 15, 2016 to March 15, 2017, submitting Certifications dated May 13, 2017 from the Regional Trial Court, Branch 18, Municipal Trial Court in Cities, Cebu City and IBP Cebu Chapter, all affirming that respondent has desisted from the practice of law and has not appeared in Court as counsel from June 15, 2016 to March 15, 2017 and finding that the documents submitted by respondents are substantial compliance with the Resolution dated June 4, 2014 and April 20, 2016 and are pieces of evidence that he has fully served the nine-month suspension from the practice of law, the Court, upon the recommendation of the OBC, resolves to LIFT the order of suspension from the practice of law and ALLOW him to RESUME his practice of law.

The said report and recommendation of the OBC is NOTED.
