APPLICABILITY OF THE RULE OF PROCEDURE FOR SMALL CLAIMS CASES
The Office of the Court Administrator has been receiving queries on the applicability of the Rule of Procedure for Small Claims Cases to the cases filed in the first level courts in view of the effectivity of the Rule on October 1,2008.
For your information, Section 26 of the Rule provides:
Sec. 26. Effectivity.- The Rule shall take effect on_ October 1, 2008 for the pilot courts designated to apply the procedure for small claims cases following its publication in the newspaper of general circulation.
Accordingly, the Rule shall be applicable only to newly filed cases in the pilot courts for small claims cases. If your court is not one of the pilot courts, then the applicable rule of procedures like the Rule on Summary Procedure, etc. shall be applied.
