SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW OF ATTY. TEODORO D. NANO, JR.
For your information and guidance, quoted hereunder is the Resolution dated 21 November 2018 of the Third Division in Administrative Case No. 8169, entitled "Calinico P. Almano vs. Atty. Teodoro D. Nano, Jr.," to wit:
The Court resolves to NOTE :
(1) complainant's Manifestation dated May 23, 2018 informing the Court that the parties have ongoing/pending civil case at the Regional Trial Court, Mati City, Davao Oriental, and respondent appeared for himself and moved for the last setting for the reception of defendant's evidence, and that respondent still maintains his law office at Ground Floor, Valles Building, Sto. Nino St., Mati City, Davao Oriental, and he is practicing his legal profession notwithstanding his suspension from the practice of law, with prayer that respondent be totally and permanently prohibited from the practice of his legal profession;
(2) respondent's comment/opposition to complainant's manifestation stating that complainant's allegation in said manifestation are all false and explaining that during the hearing on March 27, 2018, his lawyer was not present so he stood up to inform the Court that his counsel requested him to reset the hearing of the case, and that his law office is his residence and he has not notarized any document since his last notarial commission lapsed on December 31, 2013 which was never renewed to date;
(3) respondent's Compliance dated September 12, 2018 with the Resolution dated June 25, 2018, submitting a certification from the Integrated Bar of the Philippines (IBP), Davao Oriental Chapter, that he has not engaged in the practice of law and has not appeared in court since April 4, 2017 up to present; and
(4) respondent's Compliance with Prayer dated September 21, 2018 submitting a copy of the Certification issued by the IBP, Davao Oriental Chapter, that he has not engaged in the practice of law and has not appeared in court as counsel from April 4, 2017 up to present.
Acting on the Office of the Bar Confidant's (OBC) Report and Recommendation dated October 11, 2018, the Court upon the recommendation of the OBC, further resolves to LIFT the order of suspension as mandated by the Resolution of February 15, 2017 and ALLOW him to RESUME his law practice, however, his application for notarial commission, if any, cannot be granted as he is permanently disqualified from being commissioned as a notary public.
The said report and recommendation of the OBC is NOTED .
Case is considered CLOSED and TERMINATED .
