TO : THE COURT OF APPEALS, SANDIGANBAYAN, COURT OF TAX APPEALS, REGIONAL TRIAL COURTS, SHARI'A DISTRICT COURTS, METROPOLITAN TRIAL COURTS, MUNICIPAL TRIAL COURTS IN CITIES, MUNICIPAL TRIAL COURTS, MUNICIPAL CIRCUIT TRIAL COURTS, SHARI'A CIRCUIT COURTS, THE OFFICE OF THE CHIEF STATE PROSECUTOR, PUBLIC ATTORNEY'S OFFICE AND THE INTEGRATED BAR OF THE PHILIPPINES
SUBJECT : LIFTING THE DISQUALIFICATION OF ATTY. PRIMO R. RINEN, JR. FROM BEING COMMISSIONED AS NOTARY PUBLIC FOR ONE (1) YEAR
For your information and guidance, quoted hereunder is the Resolution dated 1 June 2016 of the Third Division in Administrative Case No. 8761, entitled "Wilberto C. Talisic v. Atty. Primo R. Rinen, Jr.,” to wit:
The Court resolves to NOTE respondent's undated compliance submitting to the Court certifications from the Office of the Executive Judge, Regional Trial Court, Branch 65, Infanta, Quezon and Office of the Integrated Bar of the Philippines, Quezon Chapter, Lucena City, that show he did not practice notarial work from September 17, 2014 up to the present.
It appearing that the copy of the Resolution dated August 24, 2015, which, among others, required respondent to file his sworn statement that he has fully served the one year period of disqualification from being commissioned as a notary public with certifications from the IBP chapter where he is affiliated and the Office of the Executive Judge of the Court where he practices his profession, addressed to complainant was returned unserved with postal carrier's notation "insufficient address", the Court likewise resolves to DEEM said resolution as SERVED on the addressee.
Acting on the Office of the Bar Confidant's (OBC) Report and Recommendation dated April 8, 2016 and considering that respondent has already served the one year disqualification from being commissioned as a notary public and has submitted the necessary certifications from the IBP local chapter where he belongs and the Office of the Executive Judge where he practices, the Court, upon the recommendation of the OBC, further resolves to LIFT the order disqualifying respondent from being commissioned as notary public and ALLOW him to RESUME his law practice.
The said report and recommendation of the OBC is NOTED.
Case is considered CLOSED and TERMINATED.
