SUBJECT : SUSPENSION FROM THE PRACTICE OF LAW FOR SIX (6) MONTHS OF ATTY. ALVIN CALINGIN

For your information and guidance, quoted hereunder is a portion of the Resolution of the First Division dated 05 September 2011, in Administrative Case No. 5413, entitled "Ramon Contreras vs. Atty. Alvin Calingin," to wit:

"The Court further resolves to ADOPT and APPROVE the findings and recommendations of the Integrated Bar of the Philippines. Accordingly, respondent Atty. Alvin Calingin is hereby SUSPENDED from the practice of law for six (6) months for his violation of Canons 15 and 16 of the Code of Professional ' Responsibility for failure to account money received from his client intended as final payment for the purchase of property and for his failure to observe candor, fairness and loyalty required of him, with STERN WARNING that a repetition of the same or similar act in the future will be dealt with more severely, and he is further DIRECTED to return the amount of One Hundred Thousand Pesos (P100,000.00) to complainant and SUBMIT proof of such return, within thirty (30) days from receipt of notice."

In a Resolution dated 05 December 2011, the Court DENIED with FINALITY the respondent's motion for reconsideration for lack of merit.
