SUSPENSION FROM THE PRACTICE OF LAW FOR SIX (6) MONTHS OF ATTY. MAGNO V. TORIBIO AND SUSPENSION OF HIS NOTARIAL COMMISSION FOR SIX (6) MONTHS
For your information and guidance, quoted hereunder is the dispositive portion of the Resolution of the Second Division dated 15 October 2008, in Administrative Case No. 7091 entitled, "Jofel P. Lecjaspi vs. Attys. Ramon Lanclrito and Magno Toribio", to wit:
"WHEREFORE, Atty. Magno V. Toribio is hereby found GUILTY of violating the Code of Professional Responsibility and the Rules on Notarial Practice. He is hereby SUSPENDED from the ; practice of law for six (6) months, with a stern warning that repetition of the same or similar conduct in the future will be dealt with more severely. His notarial commission, if any, is also hereby SUSPENDED for six (6) months.
The case against Atty. Ramon P. Landrito is hereby DISMISSED for lack of merit."
In the Resolution dated 15 December 2008, the Court DENIED WITH FINALITY the motion for reconsideration of Atty. Magno V, Toribio. Respondent received the Resolutions of 15 October 2008 and 15 December 2008 on 5 November 2008 as per Registry Return Receipt No 51599 and on 13 February 2009 per Registry Return Receipt No 16081., respectively.
