SUBJECT: A.M. No. 00-7-151-MTC RE: CLARIFICATION ON THE INTERPRETATION OF SECTION 20(b), RULE 141 (LEGAL FEES), REVISED RULES OF COURT.

Section 20 (b), Rule 141 of the Revised Rules of Court provides that:

For motions for postponement after the completion of the pre-trial stage, one hundred pesos (PI 00.00) for the first, and an additional fifty pesos (P50.00) for every postponement thereafter based on that for the immediately preceding motion; xxx "

In order to have a uniform interpretation of the said provision, the Third Division of this Court its resolution dated August 23, 2000 in A.M. No. 00-7-151-MTC, approved the interpretation followed by the MTC of Barili, Cebu as follows:

That for the. first postponement, the fee to be collected ' is one hundred pesos (P100.00); one hundred fifty pesos (P150.00) for the second postponement; two hundred pesos (P200.00) for the third; two hundred fifty pesos (P250.00) for the fourth and so forth.
