[ SC CIRCULAR NO. 53-2000, September 06, 2000 ]

TO:

THE COURT OF APPEALS, SANDIGANBAYAN, COURT OF TAX APPEALS, REGIONAL TRIAL COURTS, SHARI’A DISTRICT COURTS, METROPOLITAN TRIAL COURTS, MUNICIPAL TRIAL COURTS IN CITIES, MUNICIPAL TRIAL COURTS, MUNICIPAL CIRCUIT TRIAL COURTS, SMART A CIRCUIT TRIAL COURTS AND THE INTEGRATED BAR OF THE PHILIPPINES

SUBJECT: SUSPENSION OF ATTY. AMADO D. ORDEN FROM THE PRACTICE OF LAW FOR ONE (1) YEAR

Quoted hereunder for the information and guidance of all concerned are pertinent portions of the decision of the Third Division of this Court, in Administrative Case No. 4646 entitled "Rosita S. Torres vs. Atty. Amado D. Orden” dated April 6, 2000, to wit:

"xxx

Respondent's failure to submit the brief to the appellate court within the reglementary period entails disciplinary action. Not only is it a dereliction of duty to his client but also to the court as well. His shortcomings before the Court of Appeals is, in itself, already deplorable but to repeat the same infraction before this Court constitutes negligence of contumacious proportions. It is even worse that the respondent has attempted to mitigate his liability by professing ignorance of appellate procedures, a matter that, too, is inexcusable.

xxx

WHEREFORE, this Court so finds respondent Atty. Amado Orden remiss in his sworn duty to his client, and to the Bar and the Bench as well and imposes upon him the penalty of SUSPENSION from the practice of law for the period of one (1) year immediately effective upon his receipt of this judgments." xxx"

Copy of the said decision was received by Atty. Orden on May 11, 2000.

September 6, 2000.
