[ OCA CIRCULAR NO. 60-2006, March 27, 2006 ]

TO: CLERKS OF COURT OF THE FIRST-LEVEL COURTS

RE:

Collection of Mediation Fees in B.P. 22 Cases

The Alternative Dispute Resolution (ADR) Committee has called the attention of this Office that there is no uniformity in the collection of mediation fee relative to B.P. 22 cases filed by the same complainant before the same court at any one time.

Based on the reports submitted to the Finance Division of the Philippine Judicial Academy (PHILJA), some Clerks of Court collect only Five Hundred Pesos (Php500.00) for a number of cases that are consolidated. Others, pursuant to existing rules collect Five Hundred Pesos (Php500.00) per case.

The collection of only one payment for several cases is not in accordance with Section 9 of Revised Rule 141.

Henceforth, you are hereby DIRECTED to COLLECT Five Hundred Pesos (Php500.00) for EACH B.P. 22 case that is filed.

For strict compliance.

This Circular shall take effect immediately.

__ 27 __ March 2006.

PRESBITERO J. VELASCO, JR.

Court Administrator
