SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW OF ATTY. DOMINGO S. CRUZ

For your information and guidance, quoted hereunder is the Resolution dated 26 February 2018 of the First Division in Administrative Case No. 7030, entitled "Franklin C. Ramos v. Atty. Domingo S. Cruz," to wit:

The Court resolves to NOTE the following:

(1) the affidavit dated June 8, 2016 of respondent Atty. Domingo S. Cruz, stating that from May 13, 2015 until May 12, 2016, he desisted from the practice of law and did not appear in any court in compliance with the suspension order issued by the Court;

(2) the payment of court fine by respondent in the amount of Ten Thousand Pesos (P10,000.00) as evidenced by the Certification issued by the Cash Division, Financial Management Office dated September 15, 2017 and O.R. No. 18775, dated July 26, 2017, in compliance with the Resolution dated March 29, 2017;

(3) the compliance and urgent motion dated August 9, 2017 (with enclosures) of respondent, informing the Court of his compliance with the Resolution dated March 29, 2017, by paying the fine imposed upon him and by submitting the required certification from the IBP Rizal Chapter; and

(4) the Report dated October 3, 2017 of the Office of the Bar Confidant.

The Court further resolves to ADOPT and APPROVE the recommendation of the Office of the Bar Confidant in the attached Report dated October 3, 2017 (Annex "A"). Accordingly, the order of suspension from the practice of law imposed on respondent Atty. Domingo S. Cruz is LIFTED and he is ALLOWED to RESUME his practice of law.

In view thereof, the motion for early resolution dated December 13, 2017 of respondent, is NOTED WITHOUT ACTION.
