SUBJECT : SUSPENSION FROM THE PRACTICE OF LAW FOR ONE (1) YEAR OF ATTY. ANSELMO M. CARLOS

For your information and guidance, quoted hereunder is the dispositive portion of the Resolution of the Second Division dated 01 April 2013 in Administrative Case No. 9384, entitled "Christopher Gomez, et al. v. Atty. Anselmo M. Carlos," to wit:

Acting on (1) respondent's motion for review and reconsideration of the IBP Board of Governors' Resolution No. XVI11-2007-72 dated 17 August 2007 which suspended respondent from the practice of law for one (1) year and Resolution No. XX-2012-40 dated 15 January 2012 which denied respondent's motion for reconsideration of the aforesaid Resolution; (2) respondent's memorandum dated 23 April 2012; (3) complainants' motion for leave to admit (attached reply to respondent's memorandum) dated 17 September 2012; (4) aforesaid comment and/or reply to respondent's memorandum of even date; and (5) complainants' manifestation dated 24 September 2012, and considering that the Court agrees with the findings and conclusion of the Investigating Commissioner and found respondent to have committed violations of the Canons of Professional Responsibility, the Court resolves to:

1. AFFIRM the Notice of Resolution Nos. XVIII-2007-72 dated 17 August 2007 and XX-2012-40 dated 15 January 2012 of the IBP Board of Governors;

2. DENY for lack of merit respondent Atty. Anselmo M. Carlos' motion for review and reconsideration dated 28 June 2012; and

3. NOTE respondent Atty. Carlos' Memorandum dated 23 April 2012 as well as complainants' comment and/or reply to respondent's memorandum dated 17 September 2012 and manifestation dated 24 September 2012

In a Resolution dated 7 August 2013, the Court DENIED with FINALITY the respondent's motion for reconsideration of the Resolution dated 1 April 2013 for lack of merit.
