SUBJECT : SUSPENSION FROM THE PRACTICE OF LAW FOR THREE (3) MONTHS OF ATTY. NAPOLEON NINOFRANCO

For your information and guidance; quoted hereunder is the dispositive portion of the Resolution of the Second Division dated 18 August 2014 in Administrative Case No. 10181 entitled "Ruben B. Barja v. Atty. Napoleon Ninofranco," to wit:

ACCORDINGLY, we ADOPT the findings and recommendation of the Integrated Bar of the Philippines finding respondent Atty. Napoleon Ninofranco GUILTY of violation of the Code of Professional Responsibility and SUSPENDING him from the practice of law for a period of three (3) months, effective upon finality hereof, with MODIFICATION that he is ordered to restitute the amount of P7,000.00 to the complainant within 90 days from finality of this Resolution, the same with interest at the rate of 6% per annum from date of filing of this Complaint until fully paid.

Respondent did not file any motion for reconsideration thereof.
