SUBJECT : SUSPENSION FROM THE PRACTICE OF LAW FOR SIX (6) MONTHS OF ATTY. ROGER Z. REYES

For your information and guidance, quoted hereunder is the dispositive portion of the Resolution of the Second Division dated 02 February 2015 in Administrative Case No. 7050 entitled "Minda R. Austria vs. Atty. Roger Z. Reyes" to wit:

The Court resolves to ADOPT and APPROVE with modification the findings of fact, conclusions of law, and recommendations of the Office of the Bar Confidant in its Report and Recommendation dated 11 November 2014 (Annex "A") adopting the recommendation of the Investigating Commisioner in the attached Report dated 6 August 2010 (Annex "B") as approved by the Board Resolution No. XIX-2010-727 dated 29 December 2010 (Annex "C"). Accordingly, the Court resolves to:

FIND respondent Atty. Roger Z. Reyes GUILTY of Rule 1.01, Canon 1; Rules 16.01 and 16.03, Canon 16; Rule 18.03, Canon 18; and Canons 17 and 19 of the Code of Professional Responsibility;

SUSPEND respondent from the practice of law for six (6) months, with warning; and

ORDER Atty. Roger Z. Reyes to RETURN to complainant the amount of £25,000.00 with interest of 12% per annum from 1 August 2004 (date of receipt of amount) until 30 June 2013, and 6% from 1 July 2013 until fully paid.

Respondent received on 19 March 2015 the aforesaid Resolution.
