SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW OF ATTY. RICHARD BALTAZAR KILAAN

For your information and guidance, quoted hereunder is the Resolution dated 7 July 2016 of the Second Division in Administrative Case No. 9385, entitled "Mariano Agadan, et al. v. Atty. Richard Baltazar Kilaan," to wit:

Acting on the compliance with the Resolution dated 2 September 2015 of respondent Atty. Richard Baltazar Kilaan, submitting the required Certifications from: (1) the Executive Judges of the Municipal Trial Court in Cities and of the Regional Trial Court in Baguio City, and the IBP-Baguio-Benguet Chapter, all stating that respondent has desisted from practicing law from 10 January 2014 to 10 April 2014; and (2) the Office of the Clerk of Court, Regional Trial Court, Baguio City, that respondent has not notarized any documents from 1 January 2014 to 9 January 2015, with prayer that his suspension to engage in the practice of law be lifted and that he be allowed to be commissioned as notary public, and considering that respondent has fully served the three-month suspension from the practice of law and one-year disqualification from being commissioned as notary public, as mandated in the Resolution dated 11 November 2013, the Court resolves to:

1. NOTE the compliance with the Resolution dated 2 September 2015 of respondent Atty. Richard Baltazar Kilaan; and 2. LIFT the order of suspension from the practice of law for three months and one year disqualification from being commissioned as notary public imposed on Atty. Richard Baltazar Kilaan in the Resolution dated 11 November 2013, and allow Atty. Kilaan to RESUME his practice of law.

The Court NOTES the Report and Recommendation dated 25 May 2016 of the Office of the Bar Confidant.
