SUBJECT : SUSPENSION FROM THE PRACTICE OF LAW FOR ONE (1) YEAR OF ATTY. ARNEL C. CAPISTRANO

For your information and guidance, quoted hereunder is the dispositive portion of the Decision of the Third Division dated 16 April 2012, in Administrative Case No. 6903, entitled "Suzette Del Mundo vs. Atty. Arnel C. Capistrano,' to wit:

"WHEREFORE, respondent Atty. Arnel C. Capistrano, having clearly violated Canons 16 and 18 of the Code of Professional Responsibility, is SUSPENDED from the practice of law for one year with a stern warning that a repetition of the same or similar acts shall be dealt with more severely. He is ORDERED to return to Suzette Del Mundo the full amount of PhP73,500.00 within 30 days from notice hereof and DIRECTED to submit to the Court proof of such payment."

In a Resolution dated 30 July 2012, the Court further DENIED with FINALITY the respondent's motion for reconsideration as no substantial matters were raised to warrant its reconsideration. Respondent recetvecLJhe said resolution on 4 October 2012 per Registry Return Receipt No. 42895.
