SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW FOR ONE (1) MONTH OF ATTY. JUAN A. ABAYA, JR.
For your information and guidance, quoted hereunder is the Resolution of the Second Division dated 17 August 2015 in Administrative Case No. 2983 entitled "Lourdes Corres vs. Atty. Juan A. Abaya, Jr.," to wit:
Acting on the motion dated 27 March 2015 of respondent Atty. Juan A. Abaya, Jr. alleging that he had already complied and served the one-month suspension from the practice of law, and as evidenced by the attached certifications dated 26 January 2015 and 28 January 2015 from the Regional Trial Court, Br. 23, Candon City, llocos Sur and IBP llocos Sur Chapter, respectively, both affirming that respondent did not engage in the practice of law for the whole month of December 2014; and considering that based on the records, respondent has fully served the one-month suspension during the entire period of December 2014, the Court resolves to LIFT the order of suspension from the practice of law for one (1) month imposed on Atty. Juan A. Abaya, Jr. as mandated in the Resolution dated 29 February 2012 and to ALLOW him to RESUME his practice of law.
The Court NOTES the Report and Recommendation dated 7 May 2015 of the Office of the Bar Confidant.
