ADOPTING AS PART OF THE JUDICIARY'S AUSTERITY PROGRAM JOINT CIRCULAR NO. 2, SERIES OF 2004, OF THE CIVIL SERVICE COMMISSION AND THE DEPARTMENT OF BUDGET AND MANAGEMENT ON NON-MONETARY REMUNERATION FOR OVERTIME SERVICE RENDERED

WHEREAS, on 10 September 2004 the Chief Justice issued Administrative Circular No. 44-2004 entitled Adopting Measures to Reduce Expenditures and Increase Savings in Appropriations in the Judiciary;

WHEREAS, one of the measures adopted is the reduction of expenses for overtime service, which includes the reduction of the number of personnel who may be allowed to render overtime service;

WHEREAS, on 4 October 2004 the Civil Service Commission and the Department of Budget and Management issued Joint Circular No. 2 on "Non-Monetary Remuneration for Overtime Service Rendered," a copy of which is hereto attached;

WHEREAS, under the Joint Circular, in lieu of overtime pay, the employees may use as "time-off" the accrued number of hours of overtime service they rendered;

WHEREAS, the rendition of overtime service, albeit without monetary compensation, would afford the employees more benefits, such as a day off in a week, which would mean one more day for the family, savings for one day in terms of transportation and meal expenses, and time saved in traveling to and from the office;

WHEREAS, the adoption of the aforementioned Joint Circular No. 2, for the Judiciary, with the qualification hereunder stated, would give incalculable advantage and benefit to the government, to the service, and to personnel rendering overtime service.

NOW, THEREFORE, Joint Circular No. 2, series of 2004, of the Civil Service Commission and the Department of Budget and Management is hereby adopted for the Philippine Judiciary effective on the first day of May 2005, except as to the official drivers of the Chief Justice and the Associate Justices of the Supreme Court and the Presiding Justices and Associate Justices of the Court of Appeals, Sandiganbayan and the Court of Tax Appeals who may continue to receive overtime pay instead of the non-monetary remuneration therein provided.

At his discretion and if justified by compelling reasons, the Chief Justice may authorize exceptions to the application of the Joint Circular on non-remuneration for overtime service rendered.

The Court Administrator and the Supreme Court's Chief Administrative Officer shall jointly issue the appropriate guidelines for the implementation of the said Joint Circular and effectively disseminate to all concerned this Administrative Circular together with their joint guidelines.
