SUSPENSION FROM THE PRACTICE OF LAW FOR ONE (1) YEAR OF ATTY. ROGELIO 2. BAGABUYO
For your information and guidance, quoted hereunder is the dispositive portion of the Decision of the Court En Bane dated 09 October 2007, in Administrative Case No. 7006, Re: Suspension of Atty. Rogeiio Z. Bagabuyo, Former Senior State Prosecutor, to wit:
" WHEREFORE , in view of the foregoing, Atty. Rogeiio Z. Bagabuyo is found guilty of violating Rule 11.05, Canon 11 and Rule 13.02, Canon 13 of the Code of Professional Responsibility, and of violating the Lawyer's Oath, for which he is SUSPENDED from the practice of law for one (1) year effective upon finality of this Decision, with a STERN WARNING that the repetition of a similar offense shall be dealt with more severely."
In a Resolution dated 4 December 2007, the Court DENIED the Motion for Extension of Time to File Motion for Reconsideration dated 5 November 2007 filed by counsel for respondent, in view of the resolution of the Court En Bane dated 7 April 1988. The Court further CONSIDERED AS SERVED the Notice of Judgment of 9 October 2007 addressed to Atty. Rogeiio Bagabuyo, c/o Department of Justice, Padre Faura, Ermita, 1000 Manila, which notice of judgment was returned unserved with notation Retired.
In a Resolution dated 15 January 2008, the Court NOTED WITHOUT ACTION the Motion for Reconsideration of the Decision of 9 October 2007 filed by counsel for respondent, in view of the resolution of 4 December 2007.
