SUBJECT : SUSPENSION FROM THE PRACTICE OF LAW FOR SIX (6) MONTHS OF ATTY. ABELARDO B. DUMAGUING

For your information and guidance, quoted hereunder is the dispositive portion of the Resolution of the Third Division dated August 1, 2012, in Administrative Case No. 9390, entitled Emilia O. Dhaliwal vs. Atty. Abelardo B. Dumaguing, to wit:

WHEREFORE, Atty. Abelardo B. Dumaguing is adjudged GUILTY of violating Canon 16 of the Code of Professional Responsibility. He is hereby SUSPENDED from the practice of law for a period of six (6) months effective upon receipt of this Resolution. He is also ordered to return to complainant Emilia 0. Dhaliwal, the amount of P 311,819.94 with legal interest of six percent (6%) per annum from the time of his receipt of the money on September 29, 2000 up to the finality of this Resolution and twelve percent (12%) per annum from finality thereof until paid.

In a Resolution dated 04 February 2013, the Court DENIED with FINALITY the respondent's motion for reconsideration as no substantial matters were raised to warrant its reconsideration.
