RECIPIENTS OF "DANGAL NG BAYAN" OR "LINGKOD NG BAYAN" AWARDS

Quoted hereunder is the Resolution dated 13 January 2004 of. the Honorable Court En Banc issued in A.M. No. 04-1-03-SC Re: Request for Salary Adjustment and Query on Automatic Inclusion as Applicant to the Court of Appeals of Judge Clifton U. Ganay, to wit:

"(a) DECLARE that the (1) constitutional requirements for appointment to the Judiciary proscribe automatic promotion to the next higher position that Republic Act No. 6713 bestows upon Dangal ng Bayan or Lingkod ng Bayan awardees, and (2) same law does not expressly allow the incentive award of salary increase equivalent to that which the holder of a next b pier position receives as such salary . increase would resist in distortion, in pay in violation of Section 2 of Republic Act No. 6758, and

(b) x x x x Members of the Judiciary are recipients of the Dangal ng Bayan or Lingkod ng Bayan Award shall be automatically included in the list of applicants to the next higher judicial position of Associate Justice of the Court of Appeals or of the Sandiganbayan if one such position is vacant; and (2) Judicial Excellence Awuds Committee to include among its award categories the recognition of such recipient(s)."
