[ OCA CIRCULAR NO. 89-2003, July 15, 2003 ]

TO:

ALL JUDGES OF THE REGIONAL, TRIAL COURTS, METROPOLITAN TRIAL COURTS, MUNICIPAL TRIAL COURTS IN CITIES, MUNICIPAL TRIAL COURTS, AND MUNICIPAL CIRCUIT TRIAL COURTS

SUBJECT :

BENCHBOOK ON THE APPLICATION, COMPUTATION AND GRADUATION OF PENALTIES, BOOK I - REVISED PENAL CODE

The U.P. Law Center Institute of Judicial Administration (UP-IJA) has come up with the publication of Book I of the Benchbook to provide a guide in the application, computation and graduation of penalties based on Act 3815, or the Revised Penal Code (RPC), the Indeterminate Sentence Law and the Probation Law.

The Benchbook is indeed a notable contribution to help the judges in the computation and graduation of penalties for each felony, however, there is a need to review some portions thereof to conform with the existing laws and recent jurisprudence.

In view thereof, you are hereby enjoined not to use the Benchbook in the meantime that the provisions thereof are being reviewed by the Court.

For strict compliance.
