DISBARMENT OF ATTY. ALAN S. MACASA

For your information and guidance, quoted hereunder is the dispositive portion of the Resolution of the Honorable Court En Bane dated 23 July 2009, in Administrative Case No. 7815, entitled, "Dolores C. Belleza vs. Atty. Alan S. Macasa," to wit:

" WHEREFORE, respondent Atty. Alan S. Macasa is hereby found GUILTY not only of dishonesty but also of professional misconduct for prejudicing Francis John Belleza's right to counsel and to bail under Section 13 and 14(2), Article 111 of the Constitution, and for violating Canon 1, 7, 17, 18 and 19 and Rules 12.03, 16.01, 16.03 and 18.03 of the Code of Professional Responsibility. He is therefore DISBARRED from the practice of law effective immediately.

Respondent is hereby ORDERED to return to complainant Dolores C. Belleza the amount of £30,000 and P18.000 with interest at 12% per annum from the date of promulgation of this decision until payment. Respondent is further DIRECTED to submit to the Court proof of payment of the amount within ten days from payment. Failure to do so will subject him to criminal prosecution." Pursuant to the Resolution of the Honorable Court En Bane dated 1 December 2009, "the Court Resolved to CONSIDER as SERVED the Notice of Judgment dated 23 July 2009 addressed to respondent Atty. Alan S. Macasa Secretary of Sanguniang Panlungsod, La Carlota City, 6130 Negros Occidental, which notice of judgment was returned unserved with notation on the letter envelope lRTS-Moved Out."
