SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW FOR THREE (3) MONTHS OF ATTY. LUISITO MIRADOR
For your information and guidance, quoted hereunder is the Resolution of the Third Division dated 27 January 2016 in Administrative Case No. 7724, entitled "[Formerly CBD Case No. 06-1754] Rosa Tendenilla vs. Atty. Luisito Mirador," to wit:
The Court resolves to NOTE respondent's Manifestation dated November 11, 2015 stating that during his suspension, he desisted from the practice of law and had not appeared in any court and submitting certifications from the Integrated Bar of the Philippines (IBP), Laguna Chapter dated September 29, 2015 and the Office of the Clerk of Court, Binan City, Laguna dated June 30, 2015 that respondent had ceased and desisted from the practice of law for a period of three (3) months from August 13, 2008 to November 13, 2008.
Acting on the Report and Recommendation dated December 10, 2015 of the Office of the Bar Confidant (OBC), relative to the suspension of respondent from the practice of law imposed in the Resolution dated July 2, 2008, finding that records and documents filed show that respondent has fully served the three-month suspension imposed in the aforesaid resolution from August 13, 2008 to November 13, 2008 and has filed the required certifications from the IBP Laguna Chapter dated September 29, 2015 and the Office of the Executive Judge of the Regional Trial Court of Laguna dated June 30, 2015, affirming that respondent has ceased and desisted from the practice of law during the said period, the Court, upon the recommendation of the OBC, resolves to LIFT the order of suspension from the practice of law for three months imposed upon respondent and ALLOW him to RESUME his practice of law.
The said report and recommendation of the OBC is NOTED.
