SUBJECT : SUSPENSION FROM THE PRACTICE OF LAW FOR ONE (1) YEAR OF ATTY. BENIGNO M. PUNO
For your information and guidance, quoted hereunder is the dispositive portion of the Resolution of the Third Division dated 17 April 2013 in Administrative Case No. 6512, entitled "Julian M. Tallano v. Atty. Benigno M. Puno," to wit:
WHEREFORE, we find Atty. Benigno M. Puno guilty of violating Section 27 of Rule 138 of the Rules of Court and Rule 10.01 of Canon 10 of the Code of Professional Responsibility. Accordingly, we SUSPEND him from the practice of law for one (1) year. He is warned that a repetition of the same or similar act in the future shall merit a more severe sanction.
The Court further DENIED respondent's omnibus motion for lack of merit, considering that a second motion for reconsideration is a prohibited pleading under Section 2, Rule 52 in relation to Section 4, Rule 56 of the 1997 Rules of Civil Procedure, as amended.
