SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW FOR THREE (3) MONTHS OF ATTY. EDNA M. ALIBUTDAN-DIAZ
For your information and guidance, quoted hereunder is the Resolution of the Second Division dated 29 July 2015 in Administrative Case No. 10134 [formerly CBD Case No. 08-2255] (Philippine Association of Court Employees [PACE], rep. by its President Atty. Virginia C. Rafael vs. Atty. Edna M. Alibutdan-Diaz), to wit:
Acting on the Motion to Lift Order of Suspension and to Allow Respondent to Resume the Practice of Law dated 10 June 2015 filed by counsel for respondent Atty. Edna M. Alibutdan-Diaz; and considering that the Decision dated 26 November 2014 which suspended respondent Alibutdan-Diaz from the practice of law for three (3) months for violation of Rule 1.01. Canon 1, Chapter 1 of the Code of Professional Responsibility was received by respondent on 5 January 2015, that respondent started to serve her suspension on 6 January 2015 until 6 April 2015; that in the subject Motion, respondent through counsel, alleges that respondent has already fully served her suspension attaching thereto Certifications from Executive Judge Anthony Isaw, Regional Trial Court, Branch 24, Ipil, Zamboanga Sibugay, and IBP President Alberto P. Din, IBP Zamboanga Sibugay Chapter, both affirming that respondent has not appeared in court as counsel from 6 January 2015 until 6 April 2015; and that based on records, respondent had already served her suspension, the Court resolves to LIFT the order of suspension against Atty. Edna M. Alibutdan-Diaz from the practice of law for three (3) months as mandated in the Decision dated 26 November 2014, and to ALLOW her to RESUME her practice of law.
